Hearing scheduled in Roman Polanski sex case
LOS ANGELES (AP) -- A hearing for Roman Polanski's bid to have a 31-year-old sex case dismissed has been rescheduled for Feb. 17.
The date was announced Tuesday, a day after Polanski's lawyer lost a bid to disqualify all Los Angeles Superior Court judges from considering the long dormant case against the director.
Polanski's attorney, Chad Hummel, claimed the entire Los Angeles Superior Court bench is biased against the director. The California 2nd District Court of Appeal rejected the motion to disqualify the judges. It also lifted a stay that had halted court proceedings in the case.
Polanski, 75, pleaded guilty to having sex with a 13-year-old girl in Los Angeles in 1978 but fled to France before he could be sentenced.
The motion to dismiss the case cites new information from an HBO documentary, "Roman Polanski: Wanted and Desired," that documents actions of the now deceased trial judge that defense lawyers deemed inappropriate.
The district attorney's office insists that Polanski must appear in court for the hearing if he wants his motion considered. If Polanski were to return to California he would be subject to arrest as a fugitive.
Hummel, has said the director does not plan to set foot in the United States again. He argues that misconduct by the trial judge makes dismissal mandatory whether Polanski is present or not.
Polanski received a directing Oscar in absentia for the 2002 movie, "The Pianist." He has also directed such classic films as "Chinatown" and "Rosemary's Baby."
