Hearing today for man accused of beating legislator

NOBLESVILLE — A man accused of severely beating a state legislator will have his first appearance in court today.

Augustus Mendenhall, 38, will appear via closed-circuit television about 1:15 p.m. today in Hamilton County Magistrate Court. Mendenhall will likely enter a plea and determine whether he will receive a court-appointed attorney. Today, he was being held without bond in the Hamilton County Jail.

Mendenhall faces preliminary charges of attempted murder, robbery, aggravated battery, resisting law enforcement and criminal confinement.

Carmel police say Mendenhall on Saturday attempted to shoot Rep. Edward DeLaney, D-Indianapolis, with a .25-caliber pistol and when the gun jammed, began beating him.

When Carmel police arrived, Mendenhall attempted to flee, but was stunned by a Taser and arrested.

DeLaney was taken to Methodist Hospital, where he is recovering from facial fractures and a broken rib.
