Ex-state rep. Oxley charged over claim

The Marion County prosecutor filed charges today against a former state lawmaker and recent candidate for lieutenant governor who avoided a public intoxication arrest by misrepresenting himself as a legislator.

Former Rep. Dennie Oxley II, 38, faces charges of impersonation of a public servant, a Class A misdemeanor, and public intoxication, a Class B misdemeanor. A warrant was issued after charges were filed this morning in Marion Superior Court.Marion County Prosecutor Carl Brizzi scheduled a news conference for later this morning.

Police found Oxley and a 21-year-old woman drunk at a Downtown Indianapolis Citgo gas station about 1 a.m. Friday — the woman lying on the ground, and Oxley walking away carrying her high-heeled shoes, according to a probable cause affidavit. The woman, Kristin Dowlut, is a former intern for Indiana House Democrats and was working in the special session.Oxley, who lives in English, Ind., claimed to be a legislator, Indianapolis police said, and had a state representative ID card in his wallet.That status during the special session, which was still under way, would make him immune from arrest under the Indiana Constitution. A provision meant to prevent political meddling says arrests for anything but treason, a felony or breach of the peace must wait until after a legislative session has ended.But Oxley, who had served in the General Assembly since 1998, stepped down last year to run on Jill Long Thompson’s unsuccessful Democratic ticket for governor. Complicating matters: Oxley’s father, who shares the same name, took his seat in the House.Indianapolis police released Oxley to the custody of a friend, but authorities quickly learned his true status and weighed charges.The affidavit does not provide further details about where Oxley and Dowlut had been before arriving at the gas station in a cab.Oxley had a court hearing scheduled today in Southern Indiana to deal with drunken driving charges stemming from a February arrest. Special Prosecutor Barry Brown said earlier this week that he had anticipated a resolution at today’s hearing, but that case may now be on hold because of the new incident.
