Indianapolis cop shooting trial in Valparaiso turns to evidence collection

The trial in the shooting of Indianapolis police officer Jason Fishburn turned today to the crime scene investigation and what happened just after Fishburn was shot during a foot chase.

Brian Reese, 37, is charged with attempted murder and is accused of shooting Fishburn, 30, in the head and protective vest in July 2008 on Indianapolis’ Eastside. The trial, moved to Porter County in Northwest Indiana because of heavy media coverage in Central Indiana, is expected to end early next week.

In the courtroom today in Valparaiso, a defense attorney challenged the work of crime lab investigators who processed evidence at the scene, according to WTHR (Channel 13), The Star’s newsgathering partner. The defense disputes that Reese possessed the intent to kill when he shot Fishburn. Intent is an element necessary for a conviction of attempted murder.

Marion County Prosecutor Carl Brizzi also expected to call officers who shot and arrested Reese after Fishburn was wounded.

Also today, Indiana Attorney General Greg Zoeller planned to stop by the courthouse in Valparaiso and meet privately with Brizzi during a break in the trial. The purpose was to lay the groundwork for handling an expected appeal if Reese is convicted, said Bryan Corbin, Zoeller’s spokesman.

Corbin said the attorney general was in northern Indiana today already. He often consults with prosecutors about the state office’s role in criminal appeals.

“I don’t remember if a trial was in session during any of these previous huddles,” Corbin said in an e-mail, “but the ongoing Reese case makes such a dialogue all the more relevant today.”

Earlier today, Zoeller held news conferences with local officials in Porter and St. Joseph counties to discuss a program for victims of domestic violence, sexual assault and stalking, Corbin said.
