Evidence-gathering comes under scrutiny at Reese trial
A defense lawyer challenged evidence-collection efforts Thursday during the trial of a man charged with attempted murder in the shooting of Indianapolis police officer Jason Fishburn.
The Porter County jury also heard from detectives Steven Scott and Jeff Wood, who testified they shot at defendant Brian Reese and arrested him just after Fishburn was wounded.
Fishburn, now 30, was shot in the head while running after Reese on Indianapolis’ Eastside in July 2008. Another shot, to his torso, was stopped by his protective vest. Lawyers for Reese, 37, dispute that he intended to kill Fishburn.
The trial, moved to Valparaiso in Northwest Indiana because of heavy media coverage in Indianapolis, is expected to end early next week.
Crime scene specialists came under pointed cross-examination by the defense because reports contained errors, they recovered no bullets or shell casings, and they initially missed items that included a Taser tip, according to WTHR (Channel 13), The Indianapolis Star’s news-gathering partner.
Indiana Attorney General Greg Zoeller, in Valparaiso to promote a program for victims, stopped by the courthouse Thursday. During a break, he met with Marion County Prosecutor Carl Brizzi to discuss how to handle an expected appeal if Reese is convicted, said Bryan Corbin, Zoeller’s spokesman.
