Man charged with attempted murder of legislator, perhaps over old grudge

A Hamilton County court magistrate Monday set a $3 million bond for a man accused of trying to kill a state legislator last week, apparently over a 26-year-old grudge.

Augustus Mendenhall, 38, appeared via closed-circuit television Monday in Hamilton County Magistrate Court. Magistrate David Najjar set the high bond because Mendenhall doesn’t have an Indiana address and is considered a flight risk.

Najjar also entered a preliminary plea of not guilty, issued a no-contact order with the alleged victim, Rep. Edward DeLaney, D-Indianapolis, and his daughter Kathleen DeLaney and appointed an attorney for Mendenhall.

Mendenhall faces felony counts of attempted murder, robbery, aggravated battery and criminal confinement, and one misdemeanor count of resisting law enforcement. If convicted on all charges, he faces up to 110 years in prison.

DeLaney remains in Methodist Hospital, where he is recovering from broken bones surrounding his eye socket and five broken ribs.

“He is in a lot of pain, but his spirits are good,” said DeLaney’s wife, Ann DeLaney, in a written statement. “We are taking comfort in the prayers and expressions of our friends, family and well-wishers.”

Investigators think the attack may be related to a 26-year-old legal dispute over an adult bookstore on the Northwestside.

According to court documents, Mendenhall, using the alias Victor White, arranged to meet DeLaney to discuss the purchase of some local properties. When DeLaney arrived, he found Mendenhall dressed in a long-haired wig, gloves and an unusual coat.

Upon reaching their destination in the 100 block of Catherine Drive in Carmel, Mendenhall asked DeLaney if he was right with God and if he had ever done anything in his legal career he felt remorseful about, the documents stated. When DeLaney said that was between him and God, Mendenhall pulled out a .25-caliber handgun, placed it to DeLaney’s head and pulled the trigger, according to the documents. The gun didn’t fire, and Mendenhall and DeLaney struggled for the weapon.

Moments later, alerted by a resident to something suspicious happening, Carmel police arrived. Mendenhall tried to flee but was brought down with a Taser and Arrested, authorities said.

DeLaney was involved as an attorney in a legal fight after Mendenhall’s father tried to lease property to an adult bookstore in 1983. Mendenhall told reporters Monday that the litigation bankrupted his family.

He said he wanted to teach DeLaney a lesson but didn’t mean to harm him.
